Probate and the Administration Estates

The death of a loved one can be a distressing and difficult time for those who are left behind.

Fraser Dawbarns LLP can guide you through the processes surrounding death. We can advise you on all of the immediate things that will need to be taken care of in the first few days, from registering the death to organising the funeral. We can help you with applying for a Grant of Probate where the person who has died has left a Will, applying for Letters of Administration where they have not left a Will, or with making any other type of application that you may need.

We can even look after the entire administration of the deceased’s estate – including collecting in their assets (such as savings and property), paying their debts and funeral expenses, and resolving any income tax, capital gains tax and inheritance tax matters that may arise. We can then distribute the deceased’s assets in accordance with their Will or by following the rules that apply where there is no Will. Administering an estate can be a complex and time consuming matter, and we can help with any size or type of estate anywhere in England and Wales.

We are experienced in setting up trusts, and if this needs to be done in accordance with the terms of the Will we can do it for you. We can also advise you about what can be done to minimise inheritance tax following the death of your loved one, or about varying the terms of the Will if this might be appropriate due to any unforeseen family issues.

We are also more than happy to give clear and practical advice on specific matters relating to the estate, such as the sale of a property, completing paperwork for HM Revenue & Customs, or handling claims made against the estate by individuals or Government bodies. When someone dies, their loved ones are often left with a great deal to do, at a time when they may be least equipped to take this on

We can help you. We have offices in King’s Lynn, Wisbech, Downham Market, March and Ely, so we are close at hand to answer any queries that you might have, or should you need to call in to sign documents. We understand if you might find it difficult or too distressing to come in to see us – we can come to your home to see you.

Costs and Fees

We charge an hourly rate for the work carried out. In certain cases, depending on the complexity of the Estate, there may also be an additional charge based on the value of the assets in the Estate. We will always make our charges clear to you at the outset and, wherever possible, provide an actual figure.

Once the matter has begun we will liaise with you on a regular basis and will ensure that you are kept up-to-date with the costs.
