Getting a Divorce

You need to have been married for at least a year before you can get divorced and there must be an ‘irretrievable’ breakdown of the marriage. There are five criteria which prove the ground of the irretrievable breakdown of a marriage, one of which must be met for divorce proceedings to be issued.
The government has announced a change to divorce laws in England and Wales which will avoid the need to blame one party in order to prove the breakdown. This change is awaited and we will update the information on this page once the law comes into force.
