Neil John, who heads the personal injury claim team at Fraser Dawbarns, has agreed a £50,000 settlement for a man from King’s Lynn who suffered injuries at work which left him unable to continue in his job. The injuries were incurred when he was struck by a piece of flying metal. His employer’s insurers refused to accept that the incident was entirely the fault of the business but conceded that the injured man was only partly to blame. So, although the full settlement value was agreed at £100,000, the client only received half of this.

Neil comments: “This result shows that it is worth following up a potential injury claim if you are partially, but not wholly, to blame for the injuries that you incur. The client could easily have chosen not to pursue a claim if he accepted that he was partially to blame for what happened. This would have left him out of pocket, particularly as he was in his 60s and has not been able to return to his previous job”.
