Successful injury claim brought following zip wire incident

Neil John, who heads the personal injury team at Fraser Dawbarns, has obtained a compensation settlement for a local man who fractured his ankle when using a zip wire at a leisure park.  His injury was incurred as the result of the impact when he landed at the end of the zip wire run.

Neil comments: “We obtained just under £20,000 for our client after taking his case to Court when the leisure park’s insurers refused to compensate him for his injuries.  They maintained that he had been given a safety briefing when this was not the case.  The Court agreed that our client deserved compensation, but they did also deduct something from the settlement for ‘contributory negligence’ because he had lifted his feet as he approached the end of the wire.

As the summer holidays got into full swing and people take advantage of the sunshine to engage in outdoor activities at holiday and fun parks, it is important to remember to ensure that you are given a safety briefing if this is a requirement and then follow all the safety instructions.  However, if you do suffer an injury that was not entirely your fault, you may be entitled to compensation, particularly if the injury prevents you from walking and working or affects your life in other ways.  If you are unsure what you might be entitled to, it is always worth getting a legal opinion.”
