The family team at Fraser Dawbarns recently assisted a man who sought advice after separating from his wife, and the communication between them had broken down. They shared a property and, following a long marriage, they needed to reach a financial settlement and obtain a clean break. With our help, the husband was able to get the negotiations back on track and agree a financial settlement allowing him to remain in the family home while providing his wife with the lump sum she needed to purchase her own property. This meant that both their housing needs were met. The financial settlement was fair to both parties and, due to being able to resolve matters amicably, they could obtain a consent order without unnecessary litigation and costs This was approved by the Judge straight away giving them both the ‘clean break’ they desired.
This highlights the benefit of obtaining legal advice from an early stage, particularly when communications have broken down. As family lawyers, we are obliged to follow the Resolution Code of Practice, to promote dealing with matters in a conciliatory fashion and to prevent acting in a hostile, aggressive manner. This means we can assist you to have productive, positive communications with your spouse, or can even communicate on your behalf where necessary. This can save parties’ time, money and stress in such circumstances!
