The Fraser Dawbarns personal injury team has recently settled the injury claim of a local teenage cyclist who was knocked from her bike by a car while crossing the road at traffic lights.  The cyclist and the car driver disagreed about the colour of the traffic lights at the time the incident occurred and there was no CCTV to confirm either of their views.  The claim was settled on the basis that the driver and the cyclist were each equally responsible and so the cyclist received half of the compensation that would have otherwise been due given the nature of her injury.

Neil John, who heads the personal injury team, comments: “Fortunately this incident occurred at low speed and so the cyclist’s injuries were relatively minor, all be it that having a fractured wrist for a number of weeks affects what you are able to do and is therefore worthy of a claim.  Whether you are a cyclist, a pedestrian or a motorist, paying close attention to the changing colour of lights and only cycling, walking or driving when you ought is a basic safety measure which everyone should observe.  Sadly, this is not an isolated case and accidents at traffic lights are relatively common.”
