Personal Injury Claim Successes for Drivers Whose Vehicles Were Stationary
Fraser Dawbarns' personal injury specialist Neil John, based in the Wisbech office, has recently settled several separate claims for vehicle drivers whose vehicles were stationary when they were hit by a moving vehicle. Examples of these incidents include one when a lorry driver was parked in a lay-by taking his tacho break and another where the injured party was part of a crew who were working on repairing the carriageway. The injuries suffered varied quite widely and were both physical and psychological, resulting in settlements between £20,000 and £100,000.
Neil comments: "Assuming a parked vehicle is somewhere that it is supposed to be, such as in a lay-by, these types of claims benefit from the fact that it is generally easy to prove that it was the driver of the moving vehicle who was at fault. While the impact of this type of collision may sometimes be less damaging than a collision where both vehicles are moving at speed, the fact that the impact is usually totally unexpected can also mean that this is not the case or that psychological injuries are greater."
