Injury claim settlements of over £350,000 for car driver and passengers

Neil John, who heads the personal injury team at Fraser Dawbarns, has settled the injury claims of a Cambridgeshire vehicle driver, and her mother who was a back seat passenger in her car. Also in the car was a young child who, fortunately, suffered only low-level soft tissue injuries. Their car was hit by another vehicle which was emerging from a side road. The driver of the other vehicle failed to look properly before proceeding onto the main road.

The driver sustained fractures to her ribs and back, a knee injury and other leg wounds. She has been off work since the accident took place and has required multiple physio treatments. Her mother also sustained a catalogue of fractures to both upper and lower limbs, her spine and her pelvis and required multiple surgeries.

Neil John comments: “We were able to access interim payments and rehabilitation support from the insurers early in the claim process to help the family to get their lives back to as near normal as possible as quickly as was feasible after the collision took place. However, the passenger’s claim suffered what is known as a ‘contributory negligence’ deduction. This was because she was not wearing her seatbelt at the time of impact and potentially suffered worse injuries as a result. Sadly, drivers failing to look properly before proceeding at junctions continues to be a major cause of collisions on our roads and subsequent injuries.”
