Communication breakdown on divorce

The family team at Fraser Dawbarns recently assisted Mr T, who sought advice after separating from his wife, as the communication between them had broken down.

Mr and Mrs T had been married for many years and owned property together. Following the breakdown of their relationship, they needed to reach a financial settlement and obtain a ‘clean break’, meaning that neither would have any financial claim on the other in the future.

With the legal assistance Mr T received from us, they were able to get back on track and agreed a financial settlement allowing Mr T to remain in the family home. Meanwhile, Mrs T was provided with the lump sum she needed to purchase her own property. This meant that they both had their housing needs met. The financial settlement was fair to them both and, due to being able to resolve matters amicably, they could obtain a consent order without unnecessary litigation and costs. The consent order approved by the Judge straight away, giving them both the ‘clean break’ they desired.

Emma Stearman, who heads the family law team at Fraser Dawbarns, adds: “This highlights the benefit of obtaining legal advice from an early stage, particularly if communications have broken down and, sadly, there appears to be no obvious way forward without professional support. As family lawyers, we are obliged to follow the Resolution Code of Practice, to promote dealing with matters in a conciliatory fashion and to prevent acting in a hostile, aggressive manner. This means we can assist you to have productive, positive communications with your spouse, or even communicate on your behalf where necessary. This can save everyone involved time, money and stress in difficult circumstances.”
